Pursuant to New Mexico law, property is considered to be community property or separate property based on when and how it was acquired. Property that was acquired prior to the marriage, was inherited, or was received as a gift during the marriage is characterized as separate property. Property acquired during the marriage is generally considered to be community property unless it was acquired in one of the foregoing ways or was paid for with separate funds. If a party claims an asset to be his/her separate property, the burden is on that individual to prove that asset was acquired prior to marriage or in a manner that supports its separate characterization.
